Vintage Pressure Controller Trade-In Program Terms and Conditions
1. Program overview. Under this program (the “Program”), customers of Fluke Electronics Corporation in the United States and of Fluke Corporation or its other affiliates outside the United States (collectively, “Fluke”), in each case transacting under the Fluke Calibration brand (“Fluke Calibration” or “we”), may trade in a qualifying pressure controller/calibrator (“Qualifying Product”) containing a Fluke Calibration Quartz Reference Pressure Transducer (“Q‐RPT”), and purchase an eligible Fluke Calibration PM600 Pressure Module, for a discount off the list price of a new PM600 Pressure Module.
If the Qualified Product contains an eligible working Q‐RPT (“Working Q‐RPT”), the purchased PM600 Pressure Module will incorporate the Working Q‐RPT, and the discount is 65% off the price of the purchased module.
2. Eligibility. The Program is offered in all jurisdictions in which Fluke Calibration products are sold, except in the European Union and in those jurisdictions where this Program is prohibited by law. Some restrictions may apply; please check with your local Fluke Calibration sales representative for availability. The discount available under the Program cannot be transferred or otherwise redeemed for alternate products, services, or credits except as expressly authorized in these Terms & Conditions.
Employees, directors, and officers of Fluke, its parent companies, affiliated companies, subsidiaries, distributors, representatives, and those persons’ immediate families (parents, siblings, children, and spouse) and persons living in the same household (whether related or not) are not eligible to participate in the Program. Further, no employees, officers, directors, or representatives or agents of distributors or competing tool manufacturers are eligible to participate in the Program.
3. Program period. The Promotion starts at 12:01 AM (all times Pacific Time) on July 1, 2017 and remains active as long as Fluke Calibration can provide PM600 modules, at the discretion of Fluke Calibration. Fluke Calibration reserves the right to terminate the program without notice at any time.
4. Program details. Qualifying Products for the 65% savings:

If a Qualified Product contains two Working Q‐RPTs, participants may select one of two options:
- Order two PM600 Pressure Modules. In this case the Qualifying Product will become inoperable and will be scrapped.
- Order one PM600 Pressure Module. In this case Fluke Calibration will return the Qualifying Product to you with a single Working Q‐RPT still installed.
Purchase must be made from an authorized Fluke Calibration sales representative or direct from Fluke Calibration.

- The first part number covers the evaluation of the Working Q‐RPT(s) to be traded in. An As Found calibration report will be sent to you as the deliverable for this line item. Order this part number for each Working Q‐RPT in a Qualifying Product:

Unless otherwise notified to you, each of the PM600 modules that incorporates a Working Q‐RPT from a Qualifying Product has the same specification as a standard PM600 module that ships with the 6270A (please refer to the 6270A specifications on our website or in the product brochure for details). If the specifications of a Working Q‐RPT are different from PM600 specifications – for example, if the Working Q‐RPT is a premium class Q‐RPT, identifiable by a “P” at the end of the model number – its specifications will be downgraded to the PM600 specifications.
When Fluke Calibration receives the order, we will issue a Return Material Authorization (“RMA”) for the return of your Qualifying Product.
When you receive the RMA, ship the Qualifying Product to the Fluke Calibration facility in Everett, Washington. The RMA will include shipping instructions, including the specific ship‐to address.
In some cases we will be returning the Qualifying Product, or a portion of the product, to you (refer to “Production of the PM600 module,” below). All other Qualifying Products returned as a trade‐in under this Program become the property of Fluke. All costs and expenses associated with shipping and handling of Qualifying Products or otherwise (including without limitation any applicable taxes, tariffs, duties or other governmental charges) under this Promotion are the responsibility of the customer.
5. Production of the PM600 module. Upon receipt of the Qualifying Product, a Fluke Calibration service technician will inspect the product and collect As Found data. If the Qualifying Product is found to be in acceptable condition, as determined by Fluke Calibration in its sole and absolute discretion, a Fluke Calibration technician will remove the Working Q‐RPT(s) from the Qualifying Product and install it/them in PM600 module(s).
Fluke Calibration will ship the PM600 module(s) and an ISO 17025 accredited calibration report for each module to you.
If the Qualifying Product is not found to be in acceptable condition, as determined by Fluke Calibration in its sole and absolute discretion, the Q‐RPT will not be removed. Fluke Calibration will send you the As Found report and contact you to determine what you would like to do with the unit you are seeking to trade in (for example, if you would like to receive a quote for repairing the unit).
If the Qualifying Product contained two Working Q‐RPTs and only one was removed, Fluke Calibration will contact you to arrange returning the Qualifying Product to you.
Installation of a Working Q‐RPT in a PM600 module includes steps that alter the Working QRPT so that it can no longer be used in a non‐PM600 product. In some situations, it will not be possible to determine if a Working Q‐RPT meets the specifications of a PM600 until it has been installed in the PM600. Once the Qualifying Product has been shipped to Fluke, Fluke cannot guarantee that it can be returned in the original unit in working order.
6. Disclaimer. Fluke and each of its parent companies, subsidiaries, and affiliates, and each of their respective directors, officers, professional advisors, distributors, representatives, employees and agents (collectively, the “Released Parties”) will not be responsible or have any liability for: (a) any late, lost, misrouted, garbled or distorted or damaged communications, transmissions or redemption requests related to the Program; (b) telephone, electronic, hardware, software, network, Internet, or other computer‐ or communications‐related malfunctions or failures related to the Program; (c) any Program disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non‐authorized human or other intervention; or (d) any printing or typographical errors in any materials associated with the Program.
Limitations of Liability; Releases: To the fullest extent permitted by law, and except pursuant to applicable standard product warranties, by participating in the Program, you release all Released Parties from, and agree to indemnify and hold harmless all Released Parties against, any liability whatsoever, and you waive any and all causes of action, in each case arising out of or relating to in any way any claims, costs, injuries, losses, liabilities or damages of any kind arising out of or in connection with the Program or delivery, misdelivery, acceptance, possession, use of or inability to use any product under this Promotion (including, without limitation, claims, costs, injuries, losses, liabilities and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
THE RELEASED PARTIES WILL HAVE NO LIABILITY FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES, ARISING FROM OR RELATED TO YOUR PARTICIPATION IN THE PROGRAM OR USE OR INABILITY TO USE ANY EQUIPMENT PROVIDED FOR USE IN THE PROGRAM, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATIONS OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE LAWS OF SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, NOTHING IN THESE TERMS EXCLUDES OR LIMITS THE RELEASED PARTIES’ LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ANY OF THE RELEASED PARTIES’ GROSS NEGLIGENCE OR FOR FRAUD.
7. Miscellaneous. The Program and these Terms & Conditions will be governed, construed and interpreted under the laws of the State of Washington, USA without applying any conflicts or choice of law provisions under such law that might refer the construction or interpretation of any term hereof to the laws of any other jurisdiction. If any provision of these Terms & Conditions is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and, provided that the fundamental terms and conditions of these Terms & Conditions remain legal and enforceable, the remainder of these Terms & Conditions shall remain operative and binding. Participants are bound by these Terms & Conditions and by the decisions of Fluke, which are final and binding in all respects. To the extent permitted by law, Fluke reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to suspend or cancel the Program or any person’s participation in the Program should computer viruses, unauthorized human intervention or other causes beyond Fluke’s control affect the administration, security or conduct of the Program, Fluke otherwise becomes (as determined in its sole discretion) incapable of conducting the Program as planned, or for any other reason determined by Fluke to be appropriate in its sole and absolute discretion.
Participants who violate these Terms & Conditions, violate any law, rule or regulation in connection with participation in the Program, tamper with the operation of the Program, or engage in any conduct that is detrimental or unfair to Fluke, the Program or any other participant (in each case as determined in Fluke’s sole and absolute discretion) are subject to disqualification from participation in the Program and all other rights and remedies available under the law.
